Part 1 – General Data Protection Regulation (GDPR) in brief.
What and Who
The General Data Protection Regulation (GDPR) is a European Union (EU) privacy law to protect its users. It impacts all businesses around the world, enforceable since May 25, 2018. The GDPR regulates how any organisation, that is subject to the Regulation treats or uses the personal data of people located in the EU .
Personal data is any piece of data that, used alone or with other data, could identify a person. If you collect, change, transmit, erase, or otherwise use or store the personal data of EU citizens, you’ll need to comply with the GDPR. This, we do our best to do.
As of May 25, 2018, the GDPR replaces an older directive on data privacy, Directive 95/46/EC.
We need to have a consent, a legal basis, to process an EU citizen’s personal data. Under the GDPR, we may use another legal basis for processing personal data, but we rely on consent, which must be specific and verifiable. It requires a written record of when and how someone agreed to let you process their personal data. This must be unambiguous and involve clear affirmative action. This means clear language and no pre-checked consent boxes.
We wholeheartedly support and do our best to comply with the GDPR, since it is FOR people’s privacy rights – as are we. Your safety matters to us, and we’ll do what we can to do our part in keeping your data safe and only use it where absolutely needed to provide you with our newsletters and other offers that you may have requested or had interest in being informed about.
About Individual Rights
The GDPR also outlines the rights of individuals around their personal data. EU citizens have the right to ask for details about how we use their personal data and can ask us to do certain things with that data. As a business owner, you might wish to be prepared to respond to people’s request in a timely manner.
People have the right to request their personal data be corrected, provided to them, prohibited for certain uses, or removed completely. Also, be able to tell someone among others, how their personal data is being used. If they ask, we’re obligated to share the personal data we hold on an individual, or offer access to it.
What personal data we collect from our Users and why
We collect different types of personally identifiable information in order to be able to provide our services to You. Such information may include but is not limited to name, mailing address, telephone numbers, email addresses, credit card information and other. Users provide all such information voluntarily through various order forms, email messages sent to Poetry Powers Prosperity, live chat (if available), telephone, etc.
We also collect different types of non-personally identifiable information that may include referral URL’s, Users’ IP addresses, Users’ use of website, information about the browsers used by the User, etc. Some of this information may be collected through Cookies (see under ‘Cookies’ below), which are small pieces of data that are sent to your browser from a web server and are stored on your computer’s hard drive and help us identify you as the User. You have the choice to modify your browser and thus to reject these cookies.
Our trusted web host (SiteGround terms) and email newsletter service provider (MailChimp terms) have been preparing for the GDPR, modifying many of their internal practices and policies for over a year, committed as we are to achieving compliance with the GDPR that has come into effect on May 25, 2018.
They’ve updated their Data Processing Agreement and third-party vendor contracts to meet the GDPR’s requirements. They have also released tools to make it easier for us (their users) to handle your data appropriately for you (our users).
How do we use the information we collect?
We use all collected information primarily for sending you nourishing newsletters and provisioning the services you have ordered and providing you with User support, where appropriate. We may also use your information for sending periodic emails announcing important service changes, new features and news, promotional activities and events that may be of interest to you etc. You can decide NOT to receive such emails by replying to any of them with “Unsubscribe” in the subject.
If you no longer wish to receive our newsletter or other services, you can easily unsubscribe at any time with the link at the bottom of each newsletter, or let us know, and we do it from our side for you. User information is also used for improving Poetry Powers Prosperity’s business processes to make your overall user experience more rewarding. Your information can also be used for resolving ownership- and other disputes and enforcing agreements between you and Poetry Powers Prosperity.
Disclose Users’ information to third parties?
All personal information collected by Poetry Powers Prosperity is treated as strictly confidential. By default WordPress does not share any personal data with anyone (ours is a WordPress site). However, we may disclose User’s personal information if required by law. We may disclose part of Users’ personal information to our business partners, independent contractors or other third parties when this is required in order to provide you with the services you have requested or ordered.
For example: your Credit card information may be provided for payment confirmation and verification to the partnering entity involved in processing your payment; your personal payment data will only be stored as needed by the payment services provider on their secure servers. Non of your confidential payment information is retained on this site, where we will only have your name, your email address as given to us via the opt-in box or comment box, and your IP address.
The personal information of anyone who receives our newsletter is stored on our website and with our trusted newsletter emailing service provider MailChimp and our equally trusted host SiteGround, since our site is on their ground 🙂 They are both very caring and professional, and we have selected them after a thorough research of who is trustworthy and feels aligned. This doesn’t say that there aren’t others, but these two have crystallised as the best for us for what is needed at this moment now.
The use of any data provided via Poetry Powers Prosperity to these partnering service providers is governed by their own Privacy Policies and is beyond Poetry Powers Prosperity’s control, so please, have a quick read there, too, as we had mentioned above. Here they are again for your convenience — (SiteGround terms) and (MailChimp terms) — We love them, because they also have your best interest at heart, together with their great teams, who take your safety as seriously as we do. Your wellbeing is important to us – and that includes your data protection.
Poetry Powers Prosperity may transfer Users’ personal information on the occasion of a sale of the company’s business in future.
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
We keep contact form submissions for a certain period for customer service purposes, but we do not use the information submitted through them for marketing purposes. To receive our email newsletters, you would get to specifically subscribe to them via our opt-in box. We love to hear from you.
If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.
If you have an account and you log in to this site (not currently available, therefore, you can skip this paragraph for now), we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.
If you edit or publish an article (if, in the future, we were to invite guest authors and/or have our intended member site active for our growing community. Not currently applicable), an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
Embedded content from other websites
Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.
By default WordPress does not collect any analytics data. In addition to that, we have a plugin that says Google Analytics for WordPress without tracking your own visits.
How long we retain your data
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. We keep contact form entries for six months, analytics records for a year, and customer purchase records for ten years.
For users that register on our website (not applicable yet), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information. (currently not available yet, until member site comes into effect, of which we will inform you at that time via our newsletter to give you the choice as to whether you’d enjoy becoming a member of this community of kindred spirits – or just continue receiving our newsletters :D).
What rights you have over your data
If you have an account on this site (not applicable yet, see ‘member site’ mention in previous paragraph), or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
Where we send your data
Visitor comments may be checked through an automated spam detection service.
What data breach procedures we have in place
Should a data breach happen, we will undertake the necessary steps to trace and request support from our partners, depending on where that data breach happened.
What third parties we receive data from
We do not currently allow advertisements or data from third parties for this purpose on our site.
Automated decision-making and/or profiling with user data?
Our website does NOT provide a service which includes automated decision making – for example, allowing customers to apply for credit, or aggregating their data into an advertising profile.
Industry regulatory disclosure requirements
Tanya von Zychlinsky is NOT a member of a regulated industry, and NOT subject to additional privacy laws at present.
How we prevent loss, misuse or alteration of Users information
We guarantee that we and our partners strictly apply all industry standard security measures to protect your personal information. Such measures include without limitation: data encryption, password protected access to Users’ personal information (by us), limited access to the sensitive data, encrypted transfer of sensitive data submitted by the User through order forms, login forms etc. Those would all be on our partners’ secure servers, not held on this site at present.
There may be security and privacy limitations, which are beyond Poetry Powers Prosperity’s control. By choosing to provide personal information to us, you understand and agree that the security, integrity and privacy of your information cannot be 100% guaranteed.
